Oh What Tangled Webs We Weave................

Please don't miss the opportunity to read the latest U Turn!

Furloughed East pilots retain their travel for the length of the furlough.  Furloughed West pilots retain travel for 6 months from the date of furlough.

This was sent to the U-Turn by a future furloughed pilot. He asked the questions to the company that all the pilots want to ask. His name was removed by his request. Read for yourself the company’s reply.Where does the company stand on the issue of furloughed pilots?  The U-Turn see a few major holes in the company’s view, but were do the effective pilots go for help????  AWAAPA has no legal representation power, which leaves USAPA.  You decide.  Remember the U-Turn is your source for news, commentary and information, but even the U-Turn has no legal representation powers.  The Mighty U-Turn……

Subject: to add insult to the West furloughees' injury............ I pasted below a question I had for Corp Comm and the response:  VP Bular needs to get an email from everyone on this policy:   ed.bular@usairways.com============================================================1.  Will furloughed pilots and F/A's still have access to Wings and the ETC?  What about pilots and F/A's on a LOA?2.  I am fairly certain, the pre-merger US Airways allowed pilots and F/A's on furlough status to retain their travel benefits throughout the entire duration of their furlough.  What is current company policy regarding travel benefits for furloughed pilots and F/As?  What about pilots and F/A's on a LOA?Thx..........xxxxxx====================================================Hi Mike, I have a few answers to your questions, but I’m still trying to find out an answer in regards to the ETC. Furloughed East pilots retain their travel for the length of the furlough.  Furloughed West pilots retain travel for 6 months from the date of furlough.Pre-merger East furloughed flight attendants retained travel for the duration (like the pilots), although the contract didn’t at the time and still doesn’t require travel for the duration.  The CBA requires 12 months of travel. West furlough policy – is according to Company policy (The Director of Inflight shall authorize space available passes where appropriate, for a furloughed Flight Attendant and her/his eligible dependents for a period of one (1) year following the start of the furlough.  This policy is intended to be solely for job searches, relocation, house hunting, or similar travel requirements.  The Company may require documentation of the circumstances giving rise to the request.)Hope this helps. I’ll let you know when I hear something about the ETC. Subject: question for V.P. Hemmenway
Per the pilot Transition Agreement, when a combined pilot contract is ratified, the Company must implement the Nicolau list.  I would assume this means that West pilots, who are on furlough status, must be immediately recalled and will replace all active East pilots who are junior to them on the Nicolau list.Is this assumption correct?Thx........... xxxxx =======================================================xxxx, in response to your question:No, this is not correct. The seniority protocol terms in the Transition Agreement and the conditions and restrictions of  the Nicolau award each  provide that inactive pilots may not displace active pilots. This provision is found in the Transition agreement on page 6, IV-A-2. “Furloughed pilots may not bump/displace active pilots” and found in the Nicolau award on page 33, paragraph B.2. Thanks,Liz   From: xxxxxx@aol.com

<<<Furloughed pilots may not bump/displace active pilots” and found in the Nicolau award on page 33, paragraph B.2.>>> Liz, What happens under this scenario? 1. pilots eventually ratify a joint contract 2. Company implements Nicolau list, as required by the Transition Agreement 3. There are then "active" pilots who are JUNIOR (on the Nicolau list) to SENIOR pilots currently on furlough? I would assume the Company would then start paying these SENIOR pilots immediately. There is no pilot contract that I know of that allows furloughs out of seniority order when there is one list in place. In addition, these SENIOR pilots who are on furlough status will also have a good case to claim damages such as back pay, restoration of longevity, loss of benefits, loss of 401k contribution, etc. Can you please forward this to Mr. Hemmenway for a response? Thx..........XXXXX============================================================Pilots who are furloughed from the company are eligible for furlough pay, benefits and recall in accordance with Section 23 of their labor agreement.  In the event that a single contract is ratified by the pilots and the Nicolau award is implemented at pilot integration, then consistent with the Nicolau award, furloughed pilots will not bump or displace active pilots.  Any furloughs which occur after the integrated seniority list has been implemented will be processed using the integrated list.  Therefore, pilots who are in a furloughed status on the effective date of the single agreement and implementation of the integrated seniority list will remain on furlough until recalled in accordance with Section 23.    Liz
