If there's a merger with UAL, he's going to be working against us. The more he works for AWAPPA, the more he knows about us, the more he knows our strengths and our weaknesses. LEONIDAS UPDATE - May 8, 2008The Board of Directors at the Army of Leonidas is offering AWAPPA, and the America West Pilots who support them, to join us in our legal endeavors to protect the career interests of the Cactus Pilots. We believe it is in the best interests of our Pilots to join our forces together. Although it may seem as semantics, as to which group joins the other, this clearly is not the case, for the following reasons: Jeff Freund, of Bredhoff & Kaiser, is AWAPPA’s legal counsel. Mr. Freund is ALSO the lead counsel for Delta Airlines, and even MORE importantly, United Airlines. He has clearly stated that he will be representing the UAL Pilots in the event of any merger with USAirways. Clearly put, Mr. Fruend will be leaving the property in the near future, should this merger proceed, and not only cease from representing us, but instead, represent the best interests of the UAL Pilot group. Do you see any conflict of interest here? We are not comfortable discussing legal strategy with a gentleman who will most likely be our next opponent. Without Mr. Freund, there will be no legal counsel to fight the battles ahead for AWAPPA. In the past year, Mr. Freund has not taken any legal action on our behalf against ALPA National for failing to defend and present the Nicolau Award in a reasonable time period. Nor has any legal action been initiated in regards to the East walking away from joint contract negotiations, clearly a breach of contract, which they signed, per the Transition agreement.. We feel Mr. Freund’s affiliation with ALPA National takes precedence over initiating legal action against them, up to and including, a possible DFR lawsuit. It is crystal clear that the only way of protecting the careers of the America West Pilots will be through legal action. Negotiations have been fruitless and USAPA is no friend to the West.
