Ladies and Gentlemen:
This very morning, Capt.  Jerry Callahan's complaint about the US Airways Reserve Scheduling system inspired in me an analogy.  Jerry is filled with righteous indignation at the fact that Crew Scheduling has transitioned every-single-Long-Call Reserve Captain to Short-Call...save one!  Scheduling's justification is....(get this crap), there is a tropical storm in the Gulf, and weather coming through Pittsburgh, later today....
up an extra ton of fuel....it just gives me that comfort that I need to do my job with confidenceSo, I'm thinking about this, and then it hit me!   I suggested to Jerry that he call up Yarko and bitch, but that in mid-bitch, that Jerry should abruptly stop and say to Yarko: "Yarko, never mind...I understand the concept now.  The Crew Schedulers don't technically need all these Short-Call Reserves, but that they are more comfortable with a little extra...just like I am when I order , whilst simultaneously discomfiting certain others within the company, who really don't understand my job in any case ; A Win-Win, if I ever heard one!"
I further suggest that the company seriously consider a mandatory training session for Crew Schedulers....."Fool School", if you will. (non-jeopardy, of course.)

Ladies and Gentlemen, please let us not take the serial outrages lying down...okay?   We are not a "cost-center", but perhaps the single most specialized and trained and experienced professionals within the company.

Perhaps the cruelest cut of all, is the fact that our own Flight Training Dept., under Bob Skinner has lost respect for the very Line Pilots they exist solely to serve.  The corruption and contamination of the mission of Training into an instrument of (unwarranted) discipline, with the willing participation of Bob Skinner is an outrage that is cause for contempt from the pilots who actually work.  Recent events are cause for Bob's removal. Our precious AQP Program, a jewel of efficiency and cost savings for the Company and a shining light of learning, (until last week), for the Line Pilots now stinks of corruption and misuse.  I wonder what the FAA in PIT are thinking?
Yes, "Fool School" for wayward Crew Schedulers, who take on more short-call pilots than their flight plan calls for; sounds right to me...
Oh, yeah, and a trip back to the Line for some overdue perspective for Captain Bob Skinner, so that he can remember the whole point of his Training Department.

I am sad to report that Southern/Republic/Northwest Captain Mike Kellogg passed away last night, July 22, 2008.

Additionally, we were notified of the passing of UAL Capt. Dick Roberts.  The service will be at 2 p.m. on Tuesday, July 29th, at East Lawn, 5757 Greenback Lane, Sacramento, CA 95841


SPC Gets Another Delay

To all:
  I had hoped that by this Friday we would all be reading the DOJ filing in our case.  Unfortunately that has changed.  I learned last night that the DOJ requested a further delay of their filing, and this AM that the Court awarded an 8 day extension to August 5, 2008.  From the schedule I previously sent to everyone just add 8 days to each scheduled event.  That moves the final briefs to September 24th.
  With all that has been going on in regard to filings and Amicus Curiae briefs, it's important to not read anything into this procedural delay.  It is what it is at this point, an 8 day delay and nothing more.  If I get any further clarification, I will pass that along.
  One final note, and that is the information that I requested from everyone.  Legal name, current address, current telephone contact and birth date.  If you have not responded with that required information, expect a separate e-mail as a reminder.

Interesting and Predictable

Thought you might be interested in a little research I just finished.  I was wondering just how many UAL pilots would continue flying past 60 when the rule changed.  Using the 2007 pilots seniority list, I found that there are112 pilot's between seniority #6 and #4766 whos 60th birthday fell between
12-13-07 and 6-30-08.  I made a list of all these pilots.  A few days ago the new 2008 pilot's seniority list came out and I again checked to see if each of these pilots was on the new list.  Of these 112, all but five pilots continue to fly.  That's 95.5%!!  I don't know about the five who retired but some of those may be medical.
 
My only observation--Guess there were 107 pilots who decided not to take the PBGC up on their offer of $2200/ Mo.  The most junior pilot moved up about 140 numbers.  These were the pilots turning 60 between july, 2007 and 12-12-07 who were not so fortunate to make the cut.

The Sky.........

There is an old English fairy tale, Chicken Little, the premise of which is a hen (Chicken Little) eating in the barnyard when an acorn falls from a tree and strikes her on the head, Chicken Little immediately decides the sky is falling. The story continues that Chicken Little sets out to go tell the King and along way she meets all sorts of characters who decide to accompany her. In most versions, the last such character is a sly old fox who leads the animals into his cave and devours them. The morals to this story are: Not to jump to conclusions and Don't be swept into the hysteria without questioning the origin.
For the last couple of years, whenever I hear or see something revolving around the airline industry, I try to ask myself if the sky is falling? Recently, a group of retired NWA pilots requested that the NWA/DAL merger not be approved out of fear that DAL might somehow terminate the NWA pilot pension. I read the letter , I thought about what  I know and I decided the sky is NOT falling. I can't help but wonder how many people reading that letter look up to see if the sky is falling. The more I pondered, the more I worried that if their wish were to come true, if Congressman Oberstar and the DOJ were to block the merger then and only then might the sky start to fall.
For the last 48 hours the email currents have been filled with fodder from various elements of APAAD and the SPC. I have been outside several times and contrary to what you might be reading I do not think the sky is falling. It has become so easy for us to accept what we read as fact. There have been so many cracks in the sky it seems reasonable to accept that it is finally falling....don't. Get off your.........chair, go outside and look up, read what is truly being said, consider the past and the present. Is it possible that the SPC will, in it's quest to end discrimination and bring FAIR treatment to pilots,  return the nation's standard to 60? Yes, I believe it maybe, I believe that it is also highly improbable.
Would you stand for this giant step backward? Could the law return to age 60 simply because it is easier? Not very likely. Paul Emens and APAAD fought hard to get the new law, they were thrilled with the jobs that were saved, Lew Tetlow is still fighting, Lew and the SPC felt the law did not do enough, too many pilots were left out.
The SPC should have their day in court, if the sky falls it is likely to only fall in Herndon. How much longer should they be able to throw acorns at aging pilots? Wasn't it enough not to represent them through out bankruptcy? Do they need to take more than their pensions? Don't be misled, don't fall into the hysteria trap and don't throw acorns.   ALPA filed a motion to the Court of Appeals today for the right to file an Amicus Curiae in regard to the SPC case.  Those wishing to file are required to request permission from the petitioners (SPC) and the respondents (DOJ on behalf of FAA and DOT).  Since we had not responded to the ALPA call, they filed directly to the court.  It is now up to the court whether or not they allow ALPA's request under the rules of the court.  That is yet to be determined.  The filing by ALPA is attached for your review.  It is not often that a request for Amicus is denied even under objection.  What matters is the stance that they have now revealed to the court to gain Amicus entry.   
  A few weeks ago I requested some information from all who signed on to our legal filings.  It will only take a few minutes of your time.  The information needed is:
1.  Legal name
2.  Address
3.  Telephone contact
4. Date of birth

  Thanks to all who send me the internet chatter.  I read it all.  To the repeated question of will the SPC respond?  The answer is NO.  This is a landmark court case about the stripping of your constitutional rights.  It's about the single worst piece of legislation in your lifetime.  It's about ALPA claiming that their bargaining rights trump your constitutional rights.  There is only one opinion that counts, and it will be heard in the near future from the court.

In China, Pilots Fined For Quitting

In China, if quit your job as an airline pilot, you could end up owing your former employer more than $102,000. China's carriers are struggling to hold onto their crews as demand for air travel creates opportunities for pilots worldwide. Now, Air China, China Eastern Airlines and China Southern Airlines, China's largest carriers, have taken to enforcing lifetime crew contracts. And a Chinese government regulation issued in May of 2006 designed to prevent bidding wars for experienced pilots penalizes those pilots who seek opportunity abroad by allowing airlines to demand compensation for lost staff. "Everyone should follow the rules," Chen Feng, chairman of Grand China Air, told Bloomberg news. "If someone insists on leaving, he should pay the price." The situation has drawn attention from the International Federation of Air Line Pilots' Associations, which views the practice as unrelated to reality and almost like slavery. Pilots in China have begun their own work condition protests -- in March and April, crews turned around 21 flights mid-route. Others have staged hunger strikes.

As high demand in China for a limited supply of pilots continues to push salaries higher, Chen Jianguo, who is fighting his case in the courts, says, "No matter how much I earn, I should have the basic right to quit or give up the earnings." For now, the government and the Chinese airlines are trying to make sure he, and other pilots who might aspire to be like him, has the requirement to pay his former employer, as well.

I wonder if they have a word for furlough?

On Friday, July 11th, Judge Martin Reidinger issued a decision dismissing USAPA’s cause of action against AWAPPA and its co-defendants under the RICO act.  Due to fact that USAPA’s RICO claim was its sole cause of action under federal law, the federal judge dismissed the remaining state law claims “without prejudice so that these claims may be re-filed in the appropriate state court.” Read More...

Sad News

 I had planned an update for all SPC members today; however, some things are just more important.     The brotherhood of airline pilots lost a great friend yesterday.  Sam Woolsey passed away in a drowning accident in California.
  Sam was the greatest historian of the fight for justice and elimination of the FAA Age 60 Rule.  It was my great pleasure to have shared many conversations with him.  Sam Woolsey did not take sides, but rather opened his knowledge to everyone.  Sam should be remembered as he was; a great friend to all.  He will be missed.
  It would be appropriate for all to express our sympathy and gratitude to his wife Hazel Woolsey.  Kindly forward your cards and thoughts to:

Delightful Food For Serious Thought!

It seems inconceivable to me that a nation of 300 million can not replace 545 people who stand convicted -- by present facts -- of incompetence and irresponsibility.   I can't think of a single domestic problem that is not traceable directly to those 545 people.   When you fully grasp the plain truth that 545 people exercise the power of the federal government, then it must follow that what exists is what they want to exist.
